Interpretation and Definitions

Interpretation

The words in which the initial letter is capitalized have meanings defined hereunder. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

• Account — A unique account created for You to access our Service or parts of our Service.
• Affiliate — An entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• Application Portal — The portal accessible at applications.uwcindia.org and all other subdomains identified by uwcindia.org, including but not limited to teachers, parents, ngo, and reviewer subdomains.
• Colleges — The 18 United World Colleges, who shall have access to the information shared.
• Cookies — Small files placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
• Device — Any device that can access the Service such as a computer, a mobile phone or a digital tablet.
• Personal Data — Any information that relates to an identified or identifiable individual.
• Service — Application Form required to be submitted by individuals on the Application Portal.
• Service Provider — Any natural or legal person who processes the data on behalf of the UWC Committee (India). Refers to third-party companies or individuals employed to facilitate, provide, or analyze the Service.
• Usage Data — Data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
• Website — Refers to the Application Portal.
• You / Your — The individual accessing or using the Service, or the UWC Committee (India), or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

We collect Your Personal Data as specified below directly from You when You provide it to Us during the Service.

You are under no obligation to provide the Personal Data that We ask You for. However, if You do not provide Your Personal Data, You will not be able to make use of all the functions of this Application Portal or use the Service.

We may use a third-party Service Provider to assist us with some features of our Application Portal or software. Our Service Provider will receive Your Personal Data on our behalf and will not be permitted to use it for any other purpose.

Where we receive data from a third party, then that third party is responsible for ensuring that any such data is transferred to us in compliance with applicable data protection laws.

We collect limited contact details which are provided by You to provide personalized assistance during emergency situations, subject to adequate data privacy and security measures. Sharing of such contact details is purely at the discretion of the end user.

Use of Your Personal Data

We may use Your Personal Data for the following purposes:

• To provide or make this Service available — to maintain, optimize and develop our Service, including monitoring the usage of our Service.
• To manage Your Application — as a user of the Service. The Personal Data You provide gives You access to different functionalities available to You as a registered user.
• For the performance of a contract — the development, compliance and undertaking of the purchase contract for the products, items or Services You have purchased.
• To contact You — by email, telephone calls, SMS, or other equivalent forms of electronic communication regarding updates, security updates, or informative communications.

• With Colleges — The purpose of providing the Service is to ensure admission of nominated users in one of the affiliated Colleges. We shall share all Personal Data You give us through our Application Portal and Service.
• With Service Providers — to monitor and analyze the use of our Service.
• For business transfers — in connection with any merger, sale of UWC India assets, financing, or acquisition of all or a portion of our business to another UWC entity.
• With Affiliates — in which case we will require those affiliates to honour this Privacy Policy. Affiliates include any subsidiaries, joint venture partners or other companies under common control with us.
• With business partners — to offer You certain products, Services or promotions.
• With other users — When You share Personal Data in public areas with other users, such information may be viewed by all users and may be publicly distributed.
• With Your consent — We may disclose Your Personal Data for any other purpose with Your consent.

Retention & Transfer

Your Rights with Respect to Your Personal Data

We respect Your right to access and control Your Personal Data, and we will respond to requests for information and, where applicable, will correct, amend, or delete Your Personal Data.

In such cases, we will need You to respond with proof of Your identity before You can exercise these rights.

Under applicable law, You have, among others, the following rights:

Legal Basis of the Processing

We can only use Your Personal Data if we have a legal basis for doing so. We process Your Personal Data either (i) on the basis of our prevailing legitimate interest to achieve the purposes set out above; or (ii) on the basis of the necessity for the performance of the contract we have concluded with You; or (iii) on the basis of the necessity to comply with legal obligations to which we are subject. If we process Your data based on Your consent, we will ask for Your consent in a separate process.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You become aware that Your child has provided us with Personal Data, please contact us. If we become aware that Personal Data from anyone under the age of 13 has been collected without verification of parental consent, we take steps to remove that information from our servers.

If we need to rely on consent as a legal basis for processing Your information and Your country requires parental consent, we will take such parental consent in accordance with applicable data protection laws.
